Welcome to Oakstone Services. These Terms of Service ("Terms") govern your use of our appliance repair and maintenance services (the "Services"). By engaging Oakstone Services ("we," "us," "our"), you ("Client," "you," "your") agree to be bound by these Terms. Please read them carefully before using our Services.
1. **Services Provided**
Oakstone Services offers appliance repair, maintenance, and related services for residential and commercial properties. The scope of services will be determined by the service agreement or proposal accepted by the Client.
2. **Service Agreement**
A service agreement or proposal must be signed and agreed upon before any work commences. This agreement will outline the scope of work, pricing, and schedule of services. Any changes or additions to the scope of work must be documented in writing and may result in additional charges.
3. **Pricing and Payment Terms**
- **Pricing**: All prices are as outlined in the service agreement or proposal. Oakstone Services reserves the right to adjust pricing based on unforeseen circumstances or additional work required, with prior notification to the Client.
- **Payment Terms**: Payment is due upon receipt of the invoice unless otherwise specified in the service agreement. Late payments may incur a late fee of 1.5% per month on the outstanding balance.
- **Deposits**: A deposit may be required for certain services, as specified in the service agreement. This deposit is non-refundable unless the service is canceled by Oakstone Services.
4. **Cancellation and Rescheduling**
- **Client-Initiated Cancellation**: If you need to cancel or reschedule a service, please notify us at least 24 hours in advance. Cancellations made less than 24 hours before the scheduled service may result in a cancellation fee of $50.
- **Oakstone Services-Initiated Cancellation**: We reserve the right to cancel or reschedule services due to unforeseen circumstances, such as technician availability or equipment issues. We will notify you as soon as possible and arrange an alternative service time.
5. **Service Warranties**
- **Labor Warranty**: We offer a 90-day warranty on all labor performed. If the same issue recurs within 90 days, we will repair it at no additional charge.
- **Parts Warranty**: Parts installed by Oakstone Services are covered by the manufacturer's warranty. We will facilitate warranty claims on your behalf, but any costs associated with warranty claims are the responsibility of the Client unless otherwise stated.
- **Exclusions**: Our warranty does not cover issues caused by misuse, neglect, unauthorized repairs, or modifications made by others after our service.
6. **Limitations of Liability**
- Oakstone Services is not liable for any indirect, incidental, or consequential damages arising from the use of our Services.
- Our total liability for any claims related to the Services will not exceed the total amount paid by the Client for the specific service giving rise to the claim.
- We are not responsible for damages caused by pre-existing conditions, faulty installations by others, or defects in the appliances themselves.
7. **Client Responsibilities**
- **Access**: The Client must ensure that Oakstone Services has access to the premises and the necessary appliances at the scheduled service time.
- **Environment**: The Client is responsible for ensuring that the work environment is safe and free from hazards. If conditions are deemed unsafe, our technicians may refuse service until the issues are resolved.
- **Information**: The Client must provide accurate information about the appliance(s) to be serviced, including any known issues or past repairs. Failure to disclose relevant information may result in additional charges or delays.
8. **Termination**
Either party may terminate the service agreement with 30 days' written notice. If the agreement is terminated by the Client before the completion of the agreed services, the Client will be responsible for payment of all services rendered up to the termination date.
9. **Confidentiality**
Oakstone Services respects the privacy of our clients. We will not disclose any personal or business information obtained during the course of our service without the Client's consent, except as required by law.
10. **Governing Law**
These Terms are governed by and construed in accordance with the laws of the state in which the services are performed, without regard to its conflict of law principles.
11. **Dispute Resolution**
Any disputes arising from or related to these Terms or our Services will be resolved through good faith negotiations. If a resolution cannot be reached, the dispute may be submitted to mediation or arbitration in accordance with the rules of the American Arbitration Association.
12. **Amendments**
Oakstone Services reserves the right to amend these Terms at any time. Clients will be notified of any significant changes. Continued use of our Services after such amendments constitutes acceptance of the new Terms.
